Sponsor Agreement
This agreement establishes the terms under which SPARC facilitates a mediation engagement and defines the boundaries that protect the mediation process and all participants.
1. Purpose
This agreement confirms the terms under which the sponsoring organization is funding a mediation engagement facilitated by SPARC. It establishes what information the sponsor will and will not receive, and the boundaries that protect the mediation process and the individuals involved.
2. What the Sponsor Will Receive
SPARC will provide the sponsor with the following information only:
- Confirmation that the engagement has begun and is active
- The identities of the parties participating in the mediation
- Session dates and a count of sessions completed
If authorized by both parties in writing, SPARC may also provide additional characterization of the engagement — for example, confirmation that a mediation agreement was reached or a general summary of its themes — as may be appropriate for the sponsor to assess the engagement's usefulness. The scope of any such disclosure will be discussed with both parties before it is shared.
3. What the Sponsor Will Not Receive
SPARC will not share with the sponsor:
- The content of any mediation session — individual or joint
- Specific topics, disclosures, or concerns raised by either party
- The mediator's observations, impressions, or assessments of either party
- Results of any assessment administered by SPARC (e.g., CliftonStrengths, Leadership Circle Profile) or shared by either party with SPARC, including interpretations and related documents
- The terms of any mediation agreement, unless both parties authorize disclosure in writing
- Any individual details of the engagement beyond what is listed in Section 2
No individual details are shared unless explicitly cleared by the relevant party. Where information pertains to both parties, both must consent. This boundary holds regardless of the sponsor's relationship to the parties or the sponsor's role in the organization.
4. Confidentiality
The mediation process is governed by the ethical standards of the International Coaching Federation (ICF) and the Academy of Executive Coaching (AoEC). Confidentiality is foundational to effective mediation, and SPARC will not compromise it to satisfy organizational reporting expectations.
If the sponsor requires information beyond what is described in Section 2, that request must be directed to the parties — not to SPARC. Either party may choose to share information with the sponsor at their own discretion, but SPARC will not facilitate or participate in such disclosures unless all relevant parties agree in writing through a signed addendum.
For more information about how SPARC handles personal data, see our Privacy Statement.
5. Fees and Payment
Fees, invoicing, and payment terms are governed by a separate engagement letter provided before the engagement begins.
6. Duration and Termination
This agreement covers the engagement period above. Either SPARC or the sponsor may end the sponsorship arrangement with written notice.
Termination of sponsorship does not automatically terminate the mediation engagement. If the parties wish to continue the mediation independently, separate arrangements will be made between SPARC and the parties.
Pre-paid fees for unused sessions will be refunded on a pro-rated basis unless otherwise specified in this agreement.
